On October, 31st at 9:00 in the morning near the building of KBR parliament (Tolstoy’s street, Lenin’s prospect) it had been announced about a gathering of citizens anxious with the land reform’s implementation in KBR. In the opinion of Adygeyan public men, the parliament of the republic should not consider the bills frozen in December, 2008 which had led to the aggravation of the political situation in KBR.

Such opinion developed after the next session of the conciliatory commission considering questions of the land reform’s implementation in the republic, on October, 29th. In the agenda it was sounded three basic questions: first of all that concerned the rules of working of the conciliatory commission in which relation the decision to give legitimacy to any voting with results of 2/3 voices given for this or that question was adopted.

The second question at the session touched the bills establishing the using order of the lands with the view of the nomadic animal industries. In June, 2009 Adygeyan public of KBR presented the conciliatory commission the bill “About lands of nomadic animal industries”, considering the rights and the interests of all the citizens of the republic. Proceeding from the clauses of that bill, all the municipal formations from the mountain and the plane areas of KBR would receive land sites (which they had owned in the days of the collective farms) of the nomadic pastures in the foothills for cattle pasturing; thus municipal formations could dispose free sites and lease them. By means of such financial injections the budgets of villages would replenish, countrymen would have an opportunity to be engaged in the nomadic animal industries and to earn for living with fair work. However, the bill offered by Adygeyan public men, most likely, did not suit the other participants of the conciliatory commission representing Balkarian public and the regional authorities.

At the session on October, 29th the bill “About status of lands of nomadic animal industries in Kabardino-Balkarian Republic” had been presented the members of the commission being absolutely “crude”, worked out in haste by KBR parliament committee on agrarian policies and land relations. The bill was signed by the chairman of the committee Tlekhugov on October, 28th, 2009, and expert (the deputy head of the machinery, head of the department) A.V. Khamukov judgement of the same date about conformity of all clauses of the law to the federal legislation was enclosed to it.

The new bill on voting without familiarity and discussions had been born. Members of the conciliatory commission from Adygeyan public organizations asked to delay the voting on recommendation of the bill in the parliament and to give time for studying the bill and detailed discussion of each clause. During five months the bill “About nomadic animal industries”, offered by Adygeyan public men, was on consideration of the conciliatory commission, and the new bill offered by the parliament committee, has been brought one day before the voting.

Replying the request of the member of the commission, the deputy of KBR parliament A.I. Rakhaev declared that irrespective of results of the voting of the conciliatory commission, the both offered bills according to the existing legislation, would be submitted to the parliament. That is the decisions of the conciliatory commission created for settling of the disputable agrarian questions, has cleanly "recommendatory" character, and as a matter of fact has no influence on the actions of KBR parliament. A.I. Rakhaev suggested the commission to not waste time, and to vote quicker, right there and then. From the hall retorts to vote for two bills together and to send them on "completion" to the parliament were sounded.

Minister on state property and land resources of KBR Muhamed Sohov acted and declared all the members of the commission that the status of the lands concerning nomadic pastures had been already stated - all of them are in the state ownership. He suggested to not mill the wind and to vote for sending the bill to KBR parliament. On that the gathered noted that the whole sense of the conciliatory commission appeared to be absurd and looking like a show. Members of the commission declared: “if the status of the lands is certain, and it is in the state ownership what was the conciliatory commission created for at all?”

Having ignored such indignations of the members of the commission from Adygeyan public organizations, the bills were put for voting and adopted by the majority of the voices. Representatives of Adygeyan public voted against in connection with that the bills had not been discussed, been brought in the urgent order and had a number of items striking the rights and the interests of the rural municipal formations located in the plane part KBR. The “crude bill” “About status of lands of nomadic animal industries in KBR”, Clause 3 (on the lands of nomadic animal industries) fixes the property all the lands of nomadic animal industries as the property of the Kabardino-Balkarian Republic, and transfers management of them to KBR Government. That clause leaves the lands of nomadic animal industries in so-called “inter-settlement territories” and contradicts the federal legislation.

After long disputes, discussion concerned the third question of the agenda: “About projects of laws of KBR providing changes of settlements’ borders. To join the commission they invited the heads of the municipal administrations of settlements Verhniy Cheghem, Babughent, Bezenghi, Verhniaya Balkaria, Verhniy Baksan and Elbrus. They were initiators of the bills on change of the villages’ borders.

Adygeyan public organizations expressed an opinion that without adoption of the law “About nomadic animal industries” the parliament can not consider the bills changing the borders of municipal formations. One should precede another. For that reason in December, 2008 consideration of the bills in the parliament in the second reading had been frozen", as it transferred huge pasturable territories into the borders of Balkarian municipal formations and deprived the plane (Kabardian and Russian) settlements of the opportunity to use them in equal conditions. Despite of the acuteness of the question, all those bills, frozen in December, 2008 without any changes have been brought on October, 29th to consideration of the conciliatory commission for recommendation to the parliament.

The representative of the president in the parliament Z.K.Kashirokov was asked a concrete question: “whether the lands of nomadic animal industries enter into those territories for which Balkarian municipal formations Verhniy Cheghem, Babughent, Bezenghi, Verhniaya Balkaria, Verhniy Baksan and Elbrus apply?” Z.K. Kashirokov answered: “No, the lands of nomadic animal industries are not included into the borders offered in the above-stated bills”.

Z.K. Kashirokov intentionally leaded into error the members of the commission, as actually about 35 % of the areas of the lands of nomadic animal industries are in the territories. For example the settlement Bulungu (Cheghemsky area) has about 2500 hectares of arable land and applies for 4000 hectares of the lands of nomadic animal industries for inclusion into the borders, thus having 900 men of its population.

Thus, the inter-settlement territories of Chereksky, Cheghemsky and Elbrussky areas (including best lands of nomadic animal industries) where mainly Balkarian population lives, are allocated only among the municipal formations located in those areas. When historically, some plane settlements of KBR had the land areas for nomadic animal industries in those territories.

Proceeding from it, it could be made a conclusion that in Chereksky, Cheghemsky and Elbrussky areas of KBR the inter-settlement territories are allocated among municipal formations according to the federal legislation, and in the other areas of KBR (Kabardian and Russian), the inter-settlement territories are kept in the property of Kabardino-Balkarian republic and are administrated by KBR Government. In particular, in Zolsky area, with mainly Kabardian population, territories of pastures, according to the bill offered by the parliamentary commission, remain inter-settlement territories.

Those bills caused public tension in December, 2008, were returned for consideration of KBR parliament for the second reading without any changes. Under available information, KBR parliament should have considered those bills on October, 31st, 2009. Representatives of Adygeyan public declared that they did not agree with the actions that infringe upon the interests of the greater part of KBR population and they could destabilize the political situation in the republic again.
